Terms of Use for Audio Tour Alaska LLC

These Terms govern two apps from Audio Tour Alaska LLC: Alaska Wayfinder on Google Play (Android) and the Apple App Store (iOS), including Android Auto and CarPlay; and Audio Tour Alaska on Google Play and the Apple App Store. They also govern use of audiotouralaska.com. Purchases, audio, maps, and photos happen in the apps.

By downloading or using either app, or by using the website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app or the website.

The apps are built for adult drivers. The iOS listings are rated 13+. Google Play shows its own age rating by country; that is not the Apple 13+ badge. You must be old enough to use the stores’ billing in your country.

1. Google Maps and other vendors

Both apps use a map. Alaska Wayfinder also provides in-app turn-by-turn navigation using Google’s Maps, Navigation, Routes, and Places services. Using those Wayfinder features means you also agree to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. On iOS, Google’s Navigation terms dialog is shown on the phone (Tour Map) before routing; it is not shown on the CarPlay screen.

In Audio Tour Alaska, the in-app map is for display. If you tap directions to a tour start, Google Maps opens (the Google Maps app or website). Using Google Maps means you also agree to Google’s terms and privacy policy.

Catalogs, audio packs, and analytics use Amazon Web Services. In Alaska Wayfinder, photos, flags, redeem codes, and Amazon Rekognition (image-label moderation after upload, not a chatbot) also use AWS. See the Privacy Policy.

Google’s APIs restrict how map tiles and related data may be cached. We follow Google’s terms. We do not separately promise a 30-day purge as an app feature.

2. License to the tour (our content)

We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial travel in a private vehicle (your car, a rental, or a friend’s car on a private trip). The app is licensed, not sold. That license covers audio narration, scripts, map overlays, GPS chapter triggers, and software.

A purchase is not a license to run a tour business. You may not use the app, the audio, or the scripts as the guide for paying passengers, including motorcoaches, vans, shuttles, cruise excursions, lodges, or any other commercial operation, without a separate written license from Audio Tour Alaska LLC. Playing the tour over a bus PA, a van speaker, or any sound system for customers is rebroadcast / public performance and is not allowed.

You also may not:

  • Record, rip, copy, or capture the audio (including from the car speakers) to reuse it
  • Stream, post, or resell chapters, scripts, GPS trigger points, or map overlays
  • Install one personal purchase as the soundtrack for a fleet of vehicles
  • Build a competing tour from our content
  • Reverse engineer the apps except where the law expressly allows it
  • Remove a copyright or proprietary notice

Personal use in your own vehicle, with family or friends who are not paying you for a guided tour, is what you bought. For a commercial license, email sourdough@audiotouralaska.com before you use it that way.

Purchases unlock audio (and, in Alaska Wayfinder, routing) for that personal use. They do not transfer copyright. We own the narration, scripts, and software.

If you break this license, including by playing the tour for paying passengers, the license ends. Stop using the apps. We may remove a photo you uploaded. The other sections of these Terms still apply, including Indemnity and Limitation of liability.

3. Driving, weather, CarPlay, Android Auto, and the camera speed lock

The tour is meant to play over the car speakers with the phone in a cup holder or locked. In Alaska Wayfinder you may also connect to CarPlay or Android Auto. Do not hold or stare at a handheld phone while you are driving. Follow Alaska traffic law and any local distracted-driving rules.

In Alaska Wayfinder, turn-by-turn on the phone or car screen is navigation, not a reason to ignore the road. In Audio Tour Alaska, opening Google Maps for directions is the same: it is not a reason to ignore the road. Physical road signs, park rangers, highway boards, weigh stations, and emergency instructions always outrank the app.

Weather and road conditions. The app does not know if the highway is icy, closed, flooded, dark, high-wind, avalanche-prone, or under a winter storm warning. A chapter that “fires” is not permission to keep driving. You decide whether to go, slow down, pull into a safe turnout, or turn around. As far as the law allows, we are not liable if you drive in weather or conditions you cannot handle, or if you follow the map onto a seasonal, unmaintained, or closed road.

Stopping. If a chapter, pin, or photo spot makes you want to stop, use a legal pullout. Do not stop in a travel lane, on a bridge, on railroad tracks, or where a moose or tourist already blocked the shoulder.

In Alaska Wayfinder, the camera locks above about 15 mph unless someone taps I am a passenger. That tap is your statement that the person using the camera is not driving. The lock is a convenience. It is not a guaranteed block against distraction. Audio Tour Alaska does not have a camera.

You are responsible for driving safely and for tickets, crashes, injury, or death connected with use of the app, as far as the law allows. Motor vehicles and Alaska highways are inherently dangerous. We are not your chauffeur, lookout, or insurer.

4. Wilderness, wildlife, and fees

Wildlife. Chapters and pins may talk about bears, moose, eagles, and other animals. That includes any wildlife or wildlife-safety chapter. That audio is storytelling, not a wildlife-viewing permit and not a certified safety briefing. Do not approach, feed, chase, or crowd wildlife. Do not get out of the car for a photo of a bear or a moose. Do not come between a moose and a calf. If you ignore those basics and get hurt, that is your risk, not ours. As far as the law allows, we are not liable for animal encounters, attacks, or property damage from wildlife.

The outdoors. Frost heaves, rockslides, mudflats, tides, cold water, glaciers, remote stretches with no cell service, and trail conditions change. A hiking-trail mention or map pin is not a promise that the trail is open, maintained, or safe that day. The map is not a survey of who owns the land. Ownership and access rules change. A pin is not the deed.

Fees and rules. You pay your own state and national park entrance fees, parking, tolls, ferry fares, and tribal-land or private-property permissions. A stop the tour mentions is not a free pass. If you skip the fee booth, park illegally, or enter land you do not have the right to enter, that is on you. We do not collect those fees and, as far as the law allows, we are not liable for citations, towing, or trespass.

5. Not an emergency or official navigation service

The apps are educational and entertainment audio tours. Alaska Wayfinder also offers optional Google turn-by-turn. They are not an SOS beacon, emergency radio, official highway advisory, or substitute for 511, park rangers, or a weather forecast.

Cell and GPS drop out in much of Alaska. Chapters may fire late or not at all off-grid. Download audio before you lose signal. Do not rely on the app for rescue, road closures, ice, or “is this pass open.”

Activity cards, restaurants, and “worth a stop” suggestions can be wrong, closed, or out of date. They are not a safety inspection, health rating, or guarantee. You choose whether to go, what to eat, and whether a side trip is safe.

In Alaska Wayfinder, some activity cards and corresponding map pins are editorial (we chose them). Others are paid listings from local businesses and are labeled Sponsored on the activity card. A Sponsored label means the business paid to appear. It is not a promise that the place is better, safer, or open. A visit, a purchase, or a dispute at that business is between you and the business. Audio Tour Alaska does not show Sponsored listings.

6. Community photos (UGC)

Community photos apply to Alaska Wayfinder only. Audio Tour Alaska does not use the camera and does not have community photos.

Camera use is optional and is a paid-region feature. Any region pass unlocks it. There is no Wayfinder account.

If you upload a photo we receive the JPEG, a generated photo id, size, and GPS coordinates (written into the local file and sent with the upload). Uploads are limited to 10 per day per device. Your own map can show the pin immediately; the public map waits about 30 minutes (featured editorial photos may appear sooner).

You own your photo. By uploading, you grant Audio Tour Alaska LLC a worldwide, non-exclusive, royalty-free license to host, store, and display it on the community map until it is flagged, rejected, hidden, or deleted. You still own the photo; this is a license, not a transfer of copyright. We may also select an uploaded photo to display as a featured photo inside Alaska Wayfinder (for example, a highlighted pin on the Tour Map) and to show it on audiotouralaska.com and in App Store or Google Play listings to promote the app. We will not use uploaded photos in paid advertising unless you agree in writing. If you ask us to delete a photo, we will remove it from the map and from the website when we reasonably can; we may not be able to pull it from a store listing screenshot already submitted to Apple or Google.

You promise that you have the right to upload the photo, that it is lawful, and that you did not trespass on private, tribal, or restricted land to take it. What you must not upload is in User conduct. We do not automatically blur faces or plates.

Flag photo (Tour Map, another traveler’s non-featured pin) reports it to us and removes it from that device’s map. We review flags in Wayfinder Studio. Rekognition also scans uploads. We aim to act on flags and email within 24 hours; we do not guarantee instant removal. You cannot flag featured editorial photos or your own pins in-app; email sourdough@audiotouralaska.com.

If you appear in someone else’s community photo (or you are a parent or guardian of someone who does), you can use Flag photo on the Tour Map the same way any traveler can, or email sourdough@audiotouralaska.com. We aim to act within 24 hours.

7. User conduct

You are responsible for how you use the apps on an Alaska road. A chapter, a pin, a route, or a photo spot is not an instruction. You decide whether to drive, stop, get out, or approach an animal.

Driving. You will:

  • Drive the vehicle yourself, or ride with a driver who is. Do not hold or stare at a handheld phone while the vehicle is moving
  • Obey Alaska traffic law, local distracted-driving rules, road signs, rangers, highway boards, weigh stations, and emergency instructions. Those outrank the app
  • Use a legal pullout. Do not stop in a travel lane, on a bridge, on railroad tracks, or on a shoulder that is already blocked
  • Treat ice, frost heaves, gravel, drop-offs, whiteouts, high wind, avalanches, floods, closed gates, and seasonal or unmaintained roads as your problem to judge. If the highway is beyond you, slow down, turn around, or wait
  • Download audio before you lose cell service. Do not count on the app for rescue, 511, or whether a pass is open
  • In Alaska Wayfinder, leave the camera locked above about 15 mph unless the person holding the phone is a passenger who has tapped I am a passenger

Wildlife. You will not approach, feed, chase, or crowd a bear, a moose, or any other animal. You will not get out of the car for a photo of a bear or a moose. You will not step between a moose and a calf, or between a bear and its food or cubs. A wildlife chapter is a story, not a viewing permit and not a safety briefing.

Other traveler decisions. You will not:

  • Skip a park fee, park illegally, cut a gate, or enter private, tribal, or restricted land because a chapter or a pin mentioned the place
  • Treat a trail pin as a promise that the trail is open, maintained, or safe that day
  • Treat an activity card, a restaurant, or a Sponsored listing as a guarantee that the place is open, safe, or worth the stop
  • Play the tour for paying passengers, or otherwise break the license in section 2

Photos, in Alaska Wayfinder. Do not upload, post, or share anything that:

  • Is illegal, harmful, threatening, abusive, harassing, hateful, defamatory, obscene, or invasive of someone’s privacy
  • Is nudity, sexual content, or violence
  • Shows an identifiable person without that person’s permission
  • You do not have the right to share, including someone else’s copyright, trademark, or private information
  • Is false or misleading, or is spam or another unsolicited promotion
  • Contains a virus or other code meant to interrupt or damage the apps, a phone, or our servers

The service. In either app, do not scrape, crawl, or bulk-download the apps, the audio, the scripts, or the map. Do not interfere with the apps or the servers, or put an unreasonable load on them. Do not harass or threaten another person. Do not impersonate Audio Tour Alaska LLC, a park ranger, or another traveler.

We may remove a photo or other material that breaks these rules. We do not promise to screen every upload before it appears on your own map.

8. Copyright complaints

If you believe a community photo or other material in an app infringes your copyright, email sourdough@audiotouralaska.com with “Copyright” in the subject line. Include your name and a way to reach you, a description of the work you own, where the material is (for a photo: the approximate place, date, and what it shows), a statement that you believe the use is not authorized, and a statement that your notice is accurate and that you are the owner or allowed to act for the owner. We may remove the material. Sending the email does not by itself decide who owns the copyright.

9. Purchases

Purchases are sold as in-app purchases:

  • iOS: Apple StoreKit / App Store. Refunds and billing support are handled by Apple under Apple’s terms.
  • Android: Google Play Billing. Refunds and billing support are handled by Google under Google Play’s terms.

We never receive your card number. Purchases stay with that store account. An Android purchase does not unlock iOS, and an iOS purchase does not unlock Android. Restore Purchases (iOS) or Play restore can bring an existing entitlement back on a new device on the same store.

In Alaska Wayfinder, region passes (Anchorage, Kenai, Parks, Bundle) unlock audio, routing, and the camera for that personal use.

In Audio Tour Alaska, highway tours and the bundle unlock audio for that personal use. A 5-chapter trial, if you start one, is stored on the device; it is not a store subscription. There is no auto-renewing membership.

Redeem codes may be sold by Audio Tour Alaska LLC or by a third party (for example a tour-booking site). Their checkout is under their terms and privacy policy. Entering a valid unused code in the app that accepts it unlocks that tour or region on our servers. It does not create an account. A code for one app does not unlock the other. Refunds for a code bought elsewhere are handled by that seller, not by Apple or Google.

Apple. If you got an app from the Apple App Store, these Terms are between you and Audio Tour Alaska LLC, not Apple. Apple is not responsible for the app or its content and does not have to provide support for it. We, not Apple, handle claims about the app, including product claims and claims that it does not meet a legal requirement. We, not Apple, handle a claim that the app infringes someone else’s intellectual property. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also follow the App Store’s terms of service.

10. Privacy

How we collect and use location, photos, analytics, and purchase records is in the Privacy Policy, not here. In short: no login; we do not collect advertising IDs and we do not use data for Apple “tracking.” In Alaska Wayfinder, some activity cards are paid listings labeled Sponsored. We do not use your GPS to choose them.

In Audio Tour Alaska, Settings has Share anonymous usage (on by default). Turning it off stops new events and clears the on-device queue. It does not, by itself, delete events already stored on our servers.

11. Indemnity

If someone makes a claim against Audio Tour Alaska LLC, its members, employees, or agents because of what you did, you will defend that claim and pay the losses and reasonable attorneys’ fees, as far as the law allows.

That includes a claim arising out of:

  • How you drove, stopped, or used a phone in the car, including a crash, a ticket, or an injury to you, a passenger, or another person on the road
  • Wildlife you approached, fed, chased, crowded, or left the car to photograph
  • A fee you skipped, a place you parked, or land you entered without the right, including trespass on private, tribal, or restricted land
  • A side trip, trail, restaurant, or Sponsored stop you chose
  • A photo you uploaded, including copyright, privacy, trespass, or defamation
  • Commercial rebroadcast, or any other breach of the license in section 2
  • Any other violation of these Terms, of someone else’s rights, or of the law

The indemnity covers claims by passengers, other drivers, property owners, agencies, and anyone else who says our app caused a harm that came from your decision. It does not apply to a claim that we committed fraud, or to death or personal injury caused by our negligence where the law does not allow that liability to be shifted to you.

12. “As is” and limitation of liability

Alaska highways, weather, and wildlife are dangerous whether or not a chapter is playing. You assume the risks of using the apps out there, including:

  • Ice, frost heaves, gravel, drop-offs, whiteouts, high wind, avalanches, floods, darkness, and roads that are closed, seasonal, or unmaintained
  • A chapter, pin, or route that fires late, early, or not at all, or that shows a road, trail, or stop that is wrong, closed, or unsafe that day
  • No cell service, a dead battery, or a GPS fix that is off
  • An animal in the road, or an animal you chose to approach or leave the car for
  • A crash, ticket, injury, or death connected with driving, stopping, or looking at a phone
  • A fee, a tow, a citation, or a trespass claim because you entered land or skipped a booth the tour only mentioned

A playing chapter is not permission to keep going, and it is not a promise that we checked the highway, the animal, or the trail for you.

THE APPS AND THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDIO TOUR ALASKA LLC DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the apps will be uninterrupted, timely, secure, or error-free, or that a chapter, pin, activity card, or road on the map is accurate, current, open, or safe. Alaska Wayfinder’s turn-by-turn navigation is still subject to section 3. It is not a promise that the route is the right one today.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, TICKETS, UNPAID PARK FEES, TOWING, TRESPASS, CRASHES, WEATHER, ROAD CONDITIONS, WILDLIFE ENCOUNTERS, INJURY, OR DEATH, ARISING FROM YOUR USE OF THE APPS OR THE WEBSITE OR FROM YOUR INABILITY TO USE THEM. UNAUTHORIZED COMMERCIAL USE (INCLUDING TOUR-BUS REBROADCAST) DOES NOT CREATE ANY WARRANTY OR DUTY ON OUR PART AND MAY BE COPYRIGHT INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS, OR OUT OF YOUR USE OF THE APPS OR THE WEBSITE, WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNT YOU PAID FOR THE IN-APP PURCHASE OR REDEEM CODE AT ISSUE DURING THE TWELVE MONTHS BEFORE THE CLAIM. If you paid Apple, Google, or a code seller, that price is the amount. A free trial counts as zero, so the cap is fifty dollars.

The damage waiver and the cap are separate. Each still applies if a court strikes the other, and each applies whether the claim is breach of contract, breach of warranty, negligence, misrepresentation, strict liability, or another claim, as far as the law allows.

Some states (and the EEA/UK) do not allow certain disclaimers or caps. Those limits apply only as far as the law allows. Nothing in these Terms limits liability that cannot be limited, including for fraud or for death or personal injury caused by negligence where that cannot be waived.

13. Changes, contact, governing law

We may update these Terms. The effective date at the top will change. Material changes may also be noted in an app or store update. If you keep using an app or the website after that date, you accept the updated Terms. If you do not agree, stop using them.

These Terms are governed by the laws of the State of Alaska, excluding conflict-of-law rules. If the law allows, disputes will be heard in state or federal court in Anchorage, Alaska. Consumers in the EEA/UK may have additional mandatory rights in their home country. There is no arbitration clause and no class-action waiver in these Terms.
